Access
to our packages on this Web Site is conditional on your
acceptance of the Legal Information and statements shown
below. All booking and purchases are subject to availability
and e-mail (written) or by phone confirmation by Elkadi
Tours Ltd.
For
persons who are resident in the United Kingdom or any other
country of the European Union, the applicable booking and
purchase conditions are those which appear on the relevant
product pages and you must read these before confirmation
your booking or purchase. Residents of other countries must
identify themselves as such at the time of booking or purchase
and ascertain whether the booking or purchase will be accepted
from their country agent of residence and the conditions
applicable to their booking or purchase. All bookings and
purchases are also subject to the general information appearing
in our current On-Line Booking. We recommend you print a
copy of our applicable booking conditions and this additional
information together with all other relevant details relating
to your chosen pilgrimages package prior to making a booking
with us.
1. Our Agreement
When you book a pilgrimages package, a contract is made
when we or your agent confirm your booking with 50% of the
value package you booked. You must sign a booking form or
submit online booking form through www.elkaditours.com
or www.umrahtohajj.com
at the time of making your booking, which is your commitment
to pay for the whole package.
We
will send you an invoice the day after you have made the
booking. You should check this carefully to confirm that
it matches what you booked. Any money paid by the customer
to an agent under or in reflection of the contract is held
by the agent as agent for Elkadi Tours Limited, until the
date on which the agent pays the money to Elkadi Tours Limited.
You
must pay a deposit at the time you make your booking and
you must pay the rest of your package price to us or your
agents eight weeks before you leave. If you do not we may
cancel your booking and ask you to pay cancellation charges
as set up in section 9.
The
person signing the booking form accepts responsibility for
paying for all the people on the booking. They are also
responsible for keeping everyone in the party informed of
the booking details. You must be at least 18 years old to
make a booking with us.
This
agreement will be governed by English Law and any disputes
will be dealt with by the English Courts.
2. Your pilgrimage price
All packages prices are quoted in pounds Sterling. The prices
in these packages apply all session.
OUR OBLIGATION TO YOU
3. If we change or cancel your pilgrimage
We try to avoid making any changes to your pilgrimage tours
arrangements. However, we may need to make changes as your
pilgrimage tours are planned many months beforehand. If
we make any changes before your booking, we will tell you
before you finish making the booking.
There
may be some minor changes made before you leave, and if
so we will try to tell you before you leave for your pilgrimage.
Rarely we may have to make major changes to your pilgrimage.
If we make a major change, you may accept that change and
receive compensation, or cancel your pilgrimage and receive
a full refund with compensation. We will pay you compensation
according to the table below:

Compensation
arrangements do not apply to circumstances beyond our control.
We can cancel your pilgrimage in the following circumstances:
war, threat of war, riots, civil strife or terrorist activity,
industrial disputes, natural or nuclear disasters, fire,
technical problems with transport, airport closures, bad
weather conditions and similar events beyond our control.
4. Our responsibility
We arrange contracts for, accommodation, transport and other
arrangements through our partner in Saudi Arabia who we
have taken reasonable care to make sure have good reputations
and run safe and efficient businesses. We will monitor and
control the performance of our partner in Saudi and judge
their performance against the standards and customs. We
will pay compensation if our partner in Saudi fail to provide
the services we agreed with the customer.
We
will accept liability for claims for personal injury arising
as a result of our staff and our partner in Saudi being
negligent while in the course of their employment or contract.
We
cannot accept liability in the following circumstances.
a.
If you or any member of your party is at fault.
b. If the failure is the fault of someone else not connected
with providing the services, which make up the pilgrimage,
which we have confirmed, to you.
c. Any unusual or unexpected circumstances beyond our control,
which we could not have avoided even if we had used all
care possible.
d. Any event, which we or our partner in Saudi of any service
could not help, expects, or prevent.
5.
Flight delays
We cannot accept any liability for any delays in your flight
from or to UK whether the cancellation or delays is caused
by adverse weather conditions, rescheduling of time by the
airline, the airport authorities and / or the action of
air traffic controllers, mechanical breakdown, strike or
action otherwise. However, in certain circumstances you
may be able to make a claim under your travel insurance
policy.
We
do not offer any travel insurance but we recommended that
you should consider taking travel insurance for your trip
from your ABTA travel agent.
6. Accuracy of the brochure
We will provide the facilities and services advertised in
the brochure. If we or our partner in Saudi withdraw those
facilities or services or limit them for any reason, we
will try to tell you and where appropriate pay you compensation.
We cannot pay any compensation for events, which are outside
our or our partner in Saudi control. Outside the Hajj and
Ramadan season it is common for facilities and services
to be less widely available, both in your accommodation
and in your pilgrimage resort generally.
7.
No extra charges
We guarantee there will be no other charges added to the
cost of your pilgrimage.
YOUR OBLIGATION TO US
8. First things you must know
a. When you receive your tickets, you must check them carefully
and notified us or your agent immediately if you think any
of the details are incorrect. We are not liable to you for
any problems, which may arise if you do not advise us.
b. You must insure that you have fully complied with any
travel health requirements, such as vaccinations.
c. While we provide religious guides, we stress you are
responsible for the proper performance of your pilgrimage.
You must ensure that you are fully aware of all the rituals
of the pilgrimage and how to perform them.
9.
If you want to cancel your pilgrimage
If you want to cancel your booking after we have accepted
it, the person who signed your booking form, must send signed
instructions to us or to the agent whom you made your booking
from.
We
will ask you to pay cancellation charges on the table shown
below. These
Charges reflect our estimated loss as a result of dealing
with your booking to the point of cancellation, and any
other losses we may have to pay.

10.
If you want to change your booking
If you want to change your booking details in any way, we
will try to help you, although we cannot guarantee that
we will be able to do this. We charge an amendment fee of
£20 for each person on the booking. However, if you
change with seven weeks of departure, we may ask you to
pay cancellation charges on the table above.
11. Behavior
We can end your pilgrimage if your behavior or that of any
member of your party is likely in our opinion to cause distress,
damage, danger to or to annoy our other customers, employees,
property or anyone else. If you are prevented from traveling
because any person in authority thinks you appear to be
unfit to travel or likely to cause discomfort to or disturb
other people, we will not be liable to complete your pilgrimage
arrangements, and you will not be liable for any refund,
compensation or any other costs you have to pay.
12. If you have a problem
If you have a problem while you are on the pilgrimage, you
must report it immediately to our representative who will
try to prevent your pilgrimage spoilt. Unless there is a
valid reason why you failed to report your complaint to
our representative, we will not consider ourselves to be
liable for those complaints.
If
we cannot sort out your problem, you should record it on
our pilgrimage complaints report from. If we still cannot
sort the matter out to your satisfaction when you return
to your country you should contact our head office in UK,
within 14 days of returning home. We cannot accept liability
for claims you do not tell us about in that period, or if
you did not tell our representative.
